When can I use the ™ mark?

When can you actually do that and can you use names for other things?

I want to program a Minecraft plugin Among Us, may I name it Among Us?

fr

You ™ can use the symbol as you like…

This symbol indicates NOT registered brand names…

Mo

Thank you very much, I've searched the Internet for ages and wasn't sure, and before I got any problems I preferred to ask

fr

But I wouldn't call your plugin Among Us…

Ma

It is a designation that is primarily used in American business law and identifies a recognized but not yet registered trademark.

In Germany, mere use can be uncompetitive. And since you would use it in connection with two brand names, of which you are not the owner in both cases (Minecraft / Among Us) and for the use of which you do not have any permission, you would have legally set the course in advance to catch the trouble as much as possible.

Cu

TM = Trademark is a protected name that you may only use with the permission of the author.

For example, you are not allowed to build any Matell "Barbie" dolls and sell them under "Barbie" because the brand name is protected.

However, if you sell them under "Bimbinchen", that is possible.

Since you want to sell or manufacture something that is protected, you can call it what you want as long as the name is not protected.

Is "Among Us" protected?

It is also important that you point out that you do not own the trademark rights by mentioning it in the product description.

E.g. (my example with the barbie)

I sell "changing dress" for Bimbinchen doll. Also fits all Barbie dolls (TM Matell)

This symbol indicates NOT registered brand names…

That's right

You ™ can use the symbol as you like…

This is wrong. In Germany the symbol is irrelevant, in the Anglo-American area it is not.

Mo

Why?

Mo

But may I e.g. Calling a self-programmed game Among Us?

Mo

But now: Is the "AMONG US" trademark protected and how can I find out?

Mo

And since Among Us is not from Germany, that doesn't matter with Among us

Ma

No. Unless you have enough money and skilled lawyers to lead a lawsuit with Innersloth over trademark rights and to win it. Due to the popularity and reach of the title, which has been immense since last year, you would have a better chance of buying up the company with a few (dozen) million dollars and thus acquiring the rights.

As long as one of these two scenarios is not fulfilled, you have no rights to the title and Innersloth can take action at any time for omission and suspension of your project.

That's how you can see it. Although it's not entirely clear to me how you want to use it.

Mo

What do you mean use?

gu

Well, where does your name appear?

Mo

Thanks so can I call the plugin Among space or something like that?

Mo

Actually not at all…

gu

Well then… You have no problems with trademark law either.

Because above you wrote:

may I call that Among Us?

Mo

Then I'll start scraping together some money xD

Cu

For example… Yes

Mo

Ok and how can i close this thread? (Since my question has now been clarified…)

Mo

And are the map names legally protected? No right?
