If you have bought something there with real money, then yes! According to the EULA (Minecraft Terms of Service), it is not allowed to sell someone "benefits" in the game for coins that others (without money) can't get.
In the gaming scene or generally called the "PaytoWin" what applies in this case at Bausucht.net, because you not only "purely cosmetic things" acquires, but just access to the server sold (full slots access). Besides, I'm not sure how far that is in conformity with the law. Installment for ranks… OMG!
In the terms and conditions it is "sold exclusively to German citizens" and you automatically this is. But applies the Austrian law… That does not fit at all! The rest of the terms and conditions does not seem to me to be "legally checked" or formulated correctly sounds more like "kiddie server".
