Depends on the license under which the texturepack was published. Usually you violate the copyright, especially if you want to sell it (which is actually quite a cheeky thing with texturepacks)

Because you sell things that you have not created yourself, and to call this an insolence that other people do not want you to steal their work, is rather presumptuous and disrespectful.

I find paid texture packs in themselves very questionable. There was no such thing before.
