Which i9? What resolution? What is the utilization of the hardware like? Which graphics settings?
Go to the bios and activate the XMP mode that brings out a pair of FPS

Load on CPU and GPU between 48-58% RTX off and everything on low
Could it be that you still have an FPS lock in the Nvidia control software?
Nvidia expirience or control panel can't tell you exactly where that was.

I can't help you If I were you, I would go to the media market (and get upset about the price of the PC that is far too high) and ask for advice. By the way, I would warmly recommend you to overclock this CPU with water cooling. There's hardly a cpu that receives so much overclocking - you get around 3.8 Ghz at least on all cores.
