Is it allowed to use foreign modifications that are publicly available on the internet for download on multiplayer Minecraft servers?

I have a question and I would like to upload and play a multiplayer map on a multiplayer server. The map is publicly available to download but the Mapbauer is no longer active… Now I wonder if I may use this map for the server or not… I have the same problem in addition also with modifications
